Brazil Regulates Express Purchasing System (Sicx) to Streamline Procurement of Standardized Goods and Services

The regulation was enacted through Decree No. 13,106 of August 24, 2026, published in the Diário Oficial da União (Official Gazette) on August 25. Although published, the decree is not yet in effect. Under Article 39, the new rules will take effect on September 8, 2026.

The Sicx framework was previously provided for by Law No. 15,266 of November 21, 2025, which amended the Public Procurement and Administrative Contracts Act (Law No. 14,133/2021) to include e-commerce as one of the permissible grounds for accreditation when procuring common, standardized goods and services.

The goal is to align specific government purchases with commercial e-commerce practices—featuring pre-registered vendor offers, automated comparison, and direct procurement through the platform.

What Is the Express Purchasing System?

Sicx is designed for contracting common goods and services that can be standardized, compared, and repeatedly purchased, as defined by the decree.

This means the system was not created to replace all forms of public procurement. Its focus remains strictly on products and services with objective, comparable specifications.

Under the decree, the Secretariat of Management and Innovation of the Ministry of Management and Innovation in Public Services (MGI) serves as the central governing body. Its responsibilities include issuing supplementary regulations, providing the platform, and drafting accreditation notices.

The federal government has positioned Sicx as a simplified platform for buying standardized items. MGI planning documents for 2026 list the system’s regulation among key public procurement deliverables.

Is the System Operational Yet?

Not under the rules of the new decree.

Decree No. 13,106 was published on August 25, but explicitly establishes its effective date as September 8, 2026.

Furthermore, the regulations outline a phased rollout for certain functionalities:

  • Price Estimation: Until automated price estimates are functional within Sicx, buyers must check available offers for the same product or service outside the platform.
  • Financial Execution: Until automated spending-limit reservations and payment release features are active, standard public expenditure procedures will apply.

Consequently, the decree’s effective date does not imply that every feature will be fully operational on day one.

How Purchasing Works on Sicx

The model begins with supplier accreditation:

  1. Registration: Vendors seeking to sell goods or render services must submit an electronic accreditation request. Qualification requirements will be detailed in specific notices and verified through the unified registry.
  2. Cataloging Offers: Once accredited, suppliers can register offers for standardized items in their catalog.

For each covered region, vendors may specify:

  • Price
  • Delivery conditions
  • Payment terms
  • Product/service specifications

Suppliers can also offer tiered pricing based on order volume and delivery location. Additionally, offers can be added via API integration with private platforms where vendors already operate.

Continuous Supplier Access

Unlike traditional public tenders—where suppliers review an opportunity, prepare a custom bid, and compete in a one-off event—accreditation on Sicx remains permanently open. Vendors can maintain active catalog offers, enabling buyers to select them as needs arise.

Automated Price Comparison and Offer Ranking

Sicx features built-in mechanisms for price formation and estimation. Supplier quotes can be updated dynamically, and the system aggregates price data from both internal transactions and external procurement databases.

The decree also allows for:

  • Automated market price searches in the private sector.
  • System integration with the Federal Revenue Service (Receita Federal) and state/district tax authorities to access the national e-invoice database (subject to legal privacy standards).

Automated Ranking Engine

The system ranks eligible offers based on criteria set in procurement notices and system parameters.

  • CADIN Restrictions: Vendors with outstanding debts listed in the Federal Public Sector Debts Registry (Cadin) will be disqualified from selection.
  • Transparency Mandate: The governing body must ensure algorithms are auditable, maintaining technical documentation on ranking weights, parameters, and updates.
  • Tie-Breaking: Ties will be resolved according to Law No. 14,133/2021 guidelines, followed by a random draw if necessary.

Is the Top-Ranked Offer Selected Automatically?

Generally, yes. Article 19 states that selecting the highest-ranked offer requires no additional justification. However, a lower-ranked offer may be chosen if supported by a specific, objective rationale adhering to central guidelines.

Simplified Contracting for Public Agencies

Sicx eliminates several administrative steps typically required in public purchases:

  • Exemptions: Buyers are exempt from drafting reference terms (termo de referência) and custom solicitation notices.
  • Technical Studies: Preliminary technical studies (estudo técnico preliminar) are generated directly within the platform.

The buyer remains responsible for selecting the appropriate item and specifications. Once selected, completing the purchase digitally constitutes the binding agreement with the vendor.

Delivery, Acceptance, and Payment

The decree establishes a two-step receiving process:

StageTimeline
Provisional AcceptanceWithin 2 business days following delivery/service log.
Definite AcceptanceWithin 10 days of provisional receipt (capped at 30 days maximum unless specified otherwise in the notice).

Note: Tacit acceptance occurs automatically if the public buyer fails to act within the prescribed timelines. Payment is released upon definite acceptance (express or tacit).

Returns and Non-Conformity

If items are defective or non-compliant, they may be returned. The default rule requires the supplier to collect the item. However, both parties may agree to waive collection, leaving the item with the agency for use or environmentally appropriate disposal.

Market Impact and Supplier Access

Opportunities for Businesses

Sicx establishes a streamlined channel for vendors dealing in standardized, high-volume, or recurring goods and services. Accredited vendors can maintain location-specific commercial terms and scale their public sales operations.

The decree directs the system to incorporate features that lower participation barriers—particularly for small and medium-sized enterprises (SMEs)—such as mechanisms to minimize return and collection costs.

However, accreditation does not guarantee sales; selection depends on government demand and competitive ranking.

Qualification for Small Businesses

The regulation does not exempt small businesses from legal qualification requirements under Law No. 14,133/2021. However, integration with public/private platforms must comply with Complementary Law No. 123/2006, preserving statutory preferences for micro and small enterprises.

Does Sicx Replace Traditional Tenders?

No. Sicx regulates a specific e-commerce mechanism under Article 79 of Law No. 14,133/2021. It serves as an additional procurement tool for standardized goods rather than a replacement for all bidding modalities.

Scope and Platform Integration

The federal decree allows state, municipal, and district entities operating under Law No. 14,133/2021 to utilize Sicx. It is also available to:

  • State-owned enterprises (SOEs) and public-private companies.
  • Autonomous social services (System S).
  • Non-profit private entities.

Sicx can integrate with existing federal, state, or municipal public e-commerce platforms, as well as private commercial marketplaces, provided they connect with the unified registry and the National Public Procurement Portal (PNCP).

Reputation Tracking and Sanctions

  • Two-Way Rating System: Sicx tracks performance ratings for both suppliers and public buyers. Vendor metrics serve as auxiliary ranking inputs, while buyer ratings track payment punctuality, rejection rates, and tacit acceptances. Reputation ratings are informational and distinct from formal administrative penalties.
  • Enforcement & Compliance: Suppliers face administrative sanctions under Law No. 14,133/2021 for breaches, along with possible temporary suspension (cautelar) in cases of severe irregularity. Minor or curable errors may be addressed through compliance notices and formal guidance.

Distinct Capabilities: Sicx vs. Contrata+Brasil

Sicx is distinct from Contrata+Brasil. While Contrata+Brasil focuses specifically on expanding public market access for micro-entrepreneurs (MEIs) and small businesses, Sicx functions as a broader e-commerce platform for standardized purchases. Although technical integrations between the two initiatives may occur, they remain separate government programs.

Implementation Timeline

  • August 24, 2026: Decree signed.
  • August 25, 2026: Published in the Official Gazette.
  • September 8, 2026: Effective date of Decree No. 13,106/2026.

Full operational capabilities will roll out progressively as the Ministry of Management and Innovation (MGI) releases platform updates, bidding notices, and supplementary regulations.
